- Talk to a lawyer, but I think it's pretty simple with real estate. If it's not in writing it doesn't exist. There is no such thing as a verbal contract that involves the purchase of real estate. Always have an attorney, a licensed agent or a Realtor involved in a transaction if your not going to be following it that closely. That way you have somebody you can hold responsible when it all goes south.

- I assume you are talking about him becoming a real estate agent. It is a good job. However, there is no health insurance, you have to pay your own taxes, there is no 401 k plans, no insurance of any type. You are an independent contractor, and as such, you choose your own hours and everything else. But that takes discipline which someone at 24 may not have. You also may want to tell him he will need to have at least 6 months of income saved up, because it takes about that long to show any income after the initial r.e. classes, which are mandatory to become an agent in any state. - Q: Ok. I live in New Jersey. I have a full time job that is smooth, and I go to school part time. On the weekends I had a part time also. But I want to get into something else part time. My financial advisor suggested selling insurance, but I dont know about that. He said the market is saturated with Real Estate people so I don't know. Some say go for it, others say don't. - I agree with godged. It's very tough to work real estate p/t and be even remotely successful. A good way to get a feel for the business is to work as an assistant to a successful real estate salesperson (not a receptionist in a brokerage). The wages will be crap, but you're there for experience. You want to find out if you're cut out for RE, and this is a great way to do it. Checkout CL for positions or be a real go-getter (you are one right?) or call brokerages and ask for their top producers who might benefit from an assistant. RE people are making less money now, so he/she will be worried about overhead. Offer to do it for 3 months for minimum wage. Then they can evaluate and see that having you around helps them make more money. In an ideal world, you'll get your license and start working their open houses, working their lower priority listings, and basically partner up with him/her to break into the game. Good luck!

- while it may not make sense, a Mortgage broker and a Real estate broker work on two sides of a real estate purchase, their licensure is totally different and regulated by different parties most of the time. A RE broker helps a person find a property to buy or sell [if he is smart, never both in the same transaction --called dual agency]. a mortgage broker ONLY finds money. IT is possible in most states to get licensed to conduct both transactions ........and easiest to do both if doing commercial. But a mortgage broker by himself cannot hire any RE agents or brokers......he can only hire loan officers. he can open his own office and hire mortgage people,. money handlers! He has to pass a state test. and the laws are rather different when doing commercial and residential. NO degree for either position but passing a specialized state decreed curriculum is essential and passing the state test for MB's.

- No the CA real estate exam is not open book. You either know the material and pass the test or you do not. For security reasons, the following items are NOT permitted in the examination room: backpacks briefcases suitcases food drinks study materials portable computers PDAs (personal digital assistants) programmable calculators Pencils and basic calculators WILL be provided for your use; therefore, use of a personal calculator will not be allowed. You cannot inspect your book or answer sheet after the examination session has ended (Section 1798.40(e) of the California Civil Code). Cell phone use is prohibited during the examination and while out on break from the examination. All cell phones must be turned off and placed out of sight once you enter the exam room. If you took a pencil and paper examination, examination results and/or related correspondence will be mailed to you, normally within five business days after your examination. If you took an electronic examination, your results were provided to you upon completion of the exam. Additional correspondence may be mailed to you, normally within five business days after your examination. To pass the examination, you must correctly answer at least 70% of the questions (Salespersons), or 75% of the questions (Brokers) Since the examination is qualifying in nature, examinees who pass are not informed of their final score. - Here's how you do it: Contact the two or three largest real estate firms in your area. Ask them about their pre-licensing exams. Most will offer them. Try to choose a company you might like to work with. But that's not a requirement. Take the pre-licensing classes in as short a time period as possible. A typical schedule might be two evenings a week and all day Saturday for 3 weeks. Something like that is good. Don't stretch it out over months. Reason: The only reason you're taking the classes is to pass the licensing exam. A lot of what you'll learn will have no real use...but you need to know it. So you cram it into your head. Don't do an online-only program. You'll need to ask questions and get understandable answers. Don't do it at a community college. Those programs take way too long--like 2 hours an evening once a week for 20 weeks. You'll forget most of it before you take your state exam. But it doesn't matter where else. No, it's not like choosing a prestigious college. The only thing--THE ONLY THING--that matters is getting the knowledge necessary to pass the state licensing exam. Once you pass the pre-licensing program, you then take the state licensing test. Once you pass it, you can work with (not for--you'll be an independent contractor) any brokerage you want. It makes sense to seriously consider the one that you took the pre-licensing courses with--but that's not required. As a newbie, look for one that offers continuing education and additional support. You'll get a lower commission, but it's worth it. They won't be interested in you until you get that state-issued license. Your questions are good. However, I don't understand how you could have been doing research for days and not getting a straight answer. That concerns me. Hope that helps.
