The bank said they are refusing my power of attorney and he would need to be present to cash the check. I advised them he is deployed and they still denied it. Each bank may have rules on what they accept. Is this the bank that he banks with? If so, he should have contacted them before he deployed to give them the POA and advise them to allow you to do things on his behalf. If not his bank, they don't know for sure that he signed it, so they really do not have to honor it, from what I understand, just like some states do not honor a POA for certain things (like vehicle registration in my former state, you HAD to have the Special power of attorney). Hopefully JAG can help you out a little more. Its frustrating when the military tells you that this should work for you, but then it doesn'tI understand as my husband was deployed last year. Reading the articles, it looks as though Humana was NOT gagged; it was simply told to only present facts and let people decide (instead of taking a political position); I don't see anything wrong with that---provided it is applied uniformly. If it was a gag, why wasn't Humana in court claiming a free speech violation? Only reason why: It wasn't. As for issuing wage limits to banks that didn't accept or use TARP funds, I looked on Google and found nothing to support your claim; it is only on those that took their funds, and if THAT were done, it would be challenged as an ex post facto provision (a bank would not have taken the money if it knew of this).

It all depends on what type of Power of Attorney you have. There durable and non-durable. He is correct when he says there is no expiration date, but like one other person who answered your question, I would be hesitant if it was five years old. If he is incarcerated he can get another P of A free of charge by requesting it with inmate services. Perhaps you might suggest that to him and that would solve the problem of it not being accepted at some places. Another option would be to record it with the county and use a certified copy. That might help.
