- Q:My understanding is that under Crane doctrine the tax basis of the property to begin with is Equity Invested + Financing (recourse or nonrecourse doesn't matter). i.e. 20K down + 80K purchase money mortgage = 100K. What if the property is appraised for only 80K right before purchase but purchaser paid 100K? Is the tax basis 80K or 100K.In other words, is the tax basis the actual assessed value of the property or is the tax basis the total investment?Thanks,Ben
- Your understanding of Crane is correct. For purposes of calculating the gain on sale, the basis would be $100k. What Crane really said was that the net proceeds would have to include any assumed debt, in addition to any cash received -- basically that you had to include the debt on both ends of the transaction if my reading is correct. (That jives with the example in Commissioner v Tufts et al, 81-1356 so I think we're correct on that.) Where basis gets interesting is when you are calculating depreciation. At least when you convert a residential property to business use -- i.e. a rental -- you use the LESSER of the cost basis (Crane) or the FMV on the date that the property is placed in business(rental) service. In your example, the depreciable basis would be $80k since that was the lower. For calculating the gain on sale, the cost basis would still be $100k (adjusted down for any depreciation allowed or allowable while in business use of course).

- Wind becomes an issue when lifting large loads with a crane that has a long boom. On some large cranes you may see an anemometer near the end of the crane's boom. The crane operator will usually not make certain heavy lifts if the wind speed is too high. If the crane does not have an anemometer, they may be using a flag to tell them the direction of the wind and to give them a rough estimate of wind's speed.

- Balance is balance - there's no specific training but good balance will help you with all aspects of your training. A few things that helped me - tying shoelaces by getting into a crane posture rather than kneeling to the laces. The concentration on the shoe helps to balance you. Practice Crane Stance and try to keep a clear mind while in the stance - if you start worrying then you'll fall. Remember to keep the knee high and the foot pointed.

- My friend, that is a good question. According to the latest news conference from the Mayor, the crane's boom arm is secured to the structure. However, West 57th Street between Broadway and 7th Avenue is closed until farther noticed. In addition, the 57th Street-7th Avenue subway station on the N, R and Q Line is closed and trains are bypassing the station in both directions, according to the MTA. Good luck Native New Yorker
- Q:Once, I pulled a book off a shelf in a library and found a very uplifting message on a sticky note that made my day. It's inspiring me to do the same, only with paper cranes since I love origami. I'm going to college in the city, and I was thinking about writing positive messages on them and planting them everywhere (discreetly, of course). What are your thoughts on this? It sounds fun, but what are the consequences? Is it even that big of a deal, or do you think it's a waste of time?
- I love doing things like this! Whenever my friends go to the mall we do this. We put inspirational quotes and images everywhere we can. In the pockets of clothing, on top of the sale signs, all over the cafeteria. There isn't anything wrong with doing it, and people love it! I'm sure the cranes will be beautiful and many people will appreciate them. Be sure to write look inside on the outside of each crane if you're hiding the message on the inside! This is such a cool idea, I'd love it and I'm sure it won't even be a slight nuisance to anyone. Have fun!
